1. Provider and Scope

These Terms and Conditions (T&C) apply to all orders placed by consumers through the online shop “Mayn The Brand.”

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.


2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

By clicking the order button, you submit a binding order for the goods contained in the shopping cart.

The purchase contract is concluded as soon as we accept your order through an order confirmation via email or by shipping the goods.

We reserve the right to reject orders if there is a justified reason, in particular in cases of:

– Unavailability of the goods
– Errors in pricing
– Suspicion of misuse or fraud


3. Prices and Shipping Costs

All prices are stated in Euro (€).

Prices include statutory value-added tax (VAT), where applicable.

In addition to the stated prices, shipping costs may apply. These will be clearly indicated during the order process.

For international deliveries, additional customs duties, taxes, or fees may apply, which must be borne by the customer.


4. Payment

The following payment methods are available:

– Klarna
– Shopify Payments
– Additional payment methods displayed in the shop

The payment will be charged immediately upon conclusion of the contract.


5. Delivery

Delivery is made to the delivery address provided by the customer.

Delivery times are indicated in the shop. These are non-binding unless expressly agreed otherwise.

The risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods.


6. Retention of Title

The goods remain our property until full payment has been received.


7. Right of Withdrawal

Consumers have a statutory right of withdrawal.

Details regarding the right of withdrawal and the withdrawal form are provided in the separate withdrawal policy on our website.


8. Warranty

The statutory warranty rights apply.

In the event of defects, customers are entitled to subsequent performance (repair or replacement delivery).


9. Liability

We are fully liable for damages resulting from injury to life, body, or health.

We are also fully liable for damages caused by intent or gross negligence.

In the event of slight negligence involving the breach of essential contractual obligations, we are liable only for the foreseeable damage typical for the contract.

Liability under the Product Liability Act remains unaffected.


10. Storage of Contract Text

The contract text is stored by us and sent to the customer by email after the order has been placed.


11. Copyright

All content of this online shop, including images, designs, logos, and texts, is protected by copyright.

Use without explicit written consent is not permitted.


12. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only insofar as it does not restrict mandatory provisions of the law of the country in which the consumer has their habitual residence.


13. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution:

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


14. Final Provisions

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
